Description

Litigating a Hague Abduction Convention case as a domestic violence survivor-respondent can be a difficult task. Normally, because it is fairly easy to establish a petitioner’s prima facie case, practitioners focus on affirmative defenses that a respondent may have. However, there are ways to challenge a petitioner’s prima facie case successfully, thus ending the litigation early. This presentation will focus on an overview of Hague Abduction Convention litigation from a domestic violence survivor’s standpoint, a deeper look into the different aspects of a petitioner’s prima facie case, and discussions of the components of successful prima facie challenges. The presenters will include an attorney from the Narkis Golan International Child Abduction Initiative, an Initiative that focuses on providing legal representation and resources to domestic violence survivors facing Hague Abduction Convention litigation; as well as two pro bono practitioners with Hague litigation experience.
