SUMMARY:Ethical Considerations for Prosecutors in Intimate Partner and Sexu
 al Violence Cases
DESCRIPTION:A prosecutor is “the servant of the law\, the twofold aim of 
 which is that guilt shall not escape or innocence suffer. . . . It is as m
 uch his duty to refrain from improper methods calculated to produce a wron
 gful conviction as it is to use every legitimate means to bring about a ju
 st one” (<em>Berger v. United States</em>\, 295 U.S. 78\, 88 (1935)). Ac
 hieving justice in intimate partner violence and sexual violence cases req
 uires prosecutors to have a firm grasp of their legal obligations as well 
 as their ethical responsibilities throughout each stage of the criminal ju
 stice process. Intimate partner and sexual violence cases present unique e
 thical challenges related to victim privacy and confidentiality\, prosecut
 orial discretion\, recantation\, and disclosure of evidence.\n\nThis prese
 ntation will address the ethical considerations outlined above in the cont
 ext of charging decisions\, immunity\, compulsion of victim testimony\, <e
 m>Crawford</em>\, and the investigative function of a prosecutor. The pres
 enter will use hypothetical case scenarios to challenge prosecutors to eva
 luate their decision-making in the context of ethical rules and principles
 .\n\n<strong>Objectives</strong>\n\nAt the conclusion of this presentation
 \, participants will be better able to:\n<ul style="font-weight: 400">\n <
 li>Identify legal obligations in the prosecution of intimate partner and s
 exual violence cases.</li>\n <li>Articulate ethical responsibilities at ea
 ch stage of the criminal justice process.</li>\n <li>Navigate the challeng

 vidence.</li>\n <li>Approach charging decisions\, immunity\, trial publici
 ty\, compulsion of victim testimony\, and issues related to <em>Crawford</
 em> within an ethical framework.</li>\n</ul>
